Litigation Strategies for Enforcing Medicaid's EPSDT Mandate for Children's Mental Health Services

Medicaid's EPSDT provisions require that States provide all necessary mental health treatment for children; few do. Litigation is a useful strategy to enforce this mandate and to compel States to offer services that can avoid institutionalization and allow children to remain at home and in their home communities. This workshop will consider litigation techniques and obstacles to bringing a class action lawsuit for children who have been labeled with a serious psychiatric disability
